1. Acceptance of Terms
By downloading, installing, or using Santa AI, you (the parent or legal guardian) agree to these Terms & Conditions on behalf of yourself and your child. If you do not agree, please do not use the App.
2. App Description
Santa AI is a children's entertainment application that simulates magical interactions with Santa Claus through AI-powered chat, voice messages, personalised stories, and virtual video calls. The App is intended for children aged 3–17 under parental supervision.
3. Parental Responsibility
Parents and legal guardians are responsible for:
- Supervising their child's use of the App.
- Configuring the Parental Controls available in Settings.
- Ensuring the App is appropriate for their child's age and maturity.
- Managing all in-app purchase decisions (protected by a Parental Gate).
4. Subscriptions & In-App Purchases
Santa AI offers the following subscription plans:
- Weekly, Monthly, and Yearly Premium tiers.
All subscriptions:
- Are billed through your Apple ID.
- Auto-renew unless cancelled at least 24 hours before the renewal date.
- Can be managed in Apple ID > Subscriptions.
- Are non-refundable except as required by applicable law or at Apple's discretion.
A Parental Gate is shown before any purchase screen to prevent accidental child purchases.
5. Free Tier Limitations
The free tier includes daily usage limits on calls, messages, and stories. These limits exist to provide a sustainable service and encourage families to experience premium features.
6. AI-Generated Content
All Santa responses, stories, and letters are generated by AI and are for entertainment purposes only. Santa AI makes no warranties about the accuracy, completeness, or suitability of AI-generated content. The festive narrative (Santa Claus, the North Pole, elves, etc.) is fictional and intended purely for children's enjoyment.
7. Acceptable Use
You agree not to:
- Use the App for any purpose other than personal, non-commercial entertainment.
- Attempt to reverse-engineer, hack, or tamper with the App.
- Use automated tools to interact with the App's AI systems.
- Share subscription access with others outside your immediate family.
8. Intellectual Property
All content within Santa AI, including but not limited to graphics, text, AI prompts, audio, and the application code, is the intellectual property of Santa AI and its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.
9. Disclaimer of Warranties
Santa AI is provided "as is" without warranty of any kind. We do not warrant that the App will be uninterrupted, error-free, or meet your specific requirements. We are not responsible for temporary unavailability due to maintenance or third-party service interruptions (AI providers, App Store).
10. Limitation of Liability
To the maximum extent permitted by law, Santa AI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount paid by you for the App in the twelve months preceding the claim.
11. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation, or if unresolved, through binding arbitration.
12. Changes to Terms
We reserve the right to update these Terms at any time. We will provide notice of material changes through an in-app notification. Continued use of the App after changes constitutes acceptance.
